Does Disney have a right to limit your use?

Here is a question that is on my mind. Does Disney have the right to limit the rights you have as a Disney owner. When you buy a property or a timeshare, as is the case with Disney points, you have certain rights and benenfits inherent in the law. The acronym SLUDGE illustrates these rights.

S ell the points
L ease the points (rent them)
U se the points
D o nothing with them
G ive them away (will them)
E enter the property

If these are rights you have as an owner, how can Disney unilaterally change the rights and say that you can't do more than one transfer a year.

Some people may be renting the points as a business, but many owners are not in this group. They have bought the points with the understanding that they or family members and friends can enjoy the use of their membership.

What happens if the family has grown up and the need is no longer there for a two bedroom unit. You have 400 points and can't take more than a week or two of vacations and a studio is more than sufficient. Why should you be limited how you use your extra points.

To me this is not right, what do you think?

I think you either sign a contract agreeing to their terms or you don't. If enough people don't, they'll change their offer. However, at this time, supply & demand favors Disney.

I put in Donald because I like him and "yes" gets me in trouble with the "post not long enough" police.

As I understand it the transfer is only between you and another DVC member. You can still "rent" the points and make reservations in anybody's name for a many times as your points allow.

Demand means DVC is the ONLY timeshare that I am aware of that actually has increased in value. It all goes back the the 3 most important factors in real estate...location, location, and location.

Richard, thank you for the clarification I wasn't aware of that. You are right the 3 most important factors to real estate value are location, location, location, however, in this situation I think location s/b replaced with Disney, Disney, Disney. As far as the value holding itself or making a profit. This is true only because Disney is excercising their ROFR, which is keeping the value up. Please don't get me wrong, I think this is beneficial to both Disney and the current owners and I am not against it.

Going back to my original question, should Disney have the right to limit you transferring your points to another DVC member?

I'd suspect Disney can do whatever they want to within the terms of the contract that all members sign.

I think Disney lets you do all your SLUDGE items but with certain criteria built in.

Sell them - BUT Disney has first buy-back option
Lease them - BUT not more than once a year
Use them - BUT only if accommodation is available
Do nothing with them - BUT lose them after 2 years
Give them away - BUT probably pay an admin fee
Enter the property - BUT only if property is available

Sure, why wouldn't they have that right? They are not saying you don't have your "SLUDGE rights" they are just limiting how often/much a member can use some of those rights. That is not the same as "unilaterally changing" the rights. The rights are the same, members still have those same rights, there is just a "cap" placed on how certain rights can be accessed. A loophole or technicality to be sure, but still with in the rights of Disney to do so with their club.
